These Terms of Service ("Terms") govern your use of imdigitalagent's AI-powered social media management platform and services. By using our services, you agree to these Terms.
1. Acceptance of Terms
By creating an account or using our services, you confirm you are at least 18 years old, have legal authority to enter this agreement, and have the right to connect any social media accounts you provide.
2. Services
imdigitalagent provides AI-powered social media automation, content creation, DM management, lead generation, booking management, analytics, email/SMS automation, and related services for small businesses.
3. Your Responsibilities
You are responsible for: maintaining accurate account information; all content posted through our platform; ensuring compliance with each connected social media platform's terms of service; and any activity under your account.
4. Acceptable Use
You agree NOT to use our services to post spam, engage in deceptive practices, harass others, violate platform terms, send mass unsolicited messages, infringe intellectual property, or engage in any illegal activities.
5. Social Media Account Authorization
When you connect social media accounts, you authorize us to publish content, manage messages, and access analytics on your behalf via official OAuth protocols. You represent that you have legal rights to all connected accounts.
6. Content Ownership
You retain ownership of all content you create or provide. AI-generated content created on your behalf is provided for your use. You are responsible for reviewing AI-generated content before publication. We do not warrant AI content accuracy.
7. Billing
Services are billed monthly with a one-time setup fee. All fees are due in advance and non-refundable except as required by law. We provide 30 days notice of price changes. You may cancel at any time; cancellation takes effect at end of current billing period.
8. Third-Party Platform Compliance
You are solely responsible for compliance with all connected platform terms, including Meta, TikTok, YouTube, LinkedIn, X, WhatsApp, Pinterest, Snapchat, Reddit, and all others. Violations of platform terms are not grounds for refund.
9. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT UNINTERRUPTED SERVICE, AI CONTENT ACCURACY, OR THAT ANY PARTICULAR BUSINESS RESULTS WILL BE ACHIEVED.
10. Limitation of Liability
OUR TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID IN THE 3 MONTHS PRECEDING A CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES INCLUDING LOST PROFITS OR REPUTATIONAL HARM.
11. Indemnification
You agree to indemnify imdigitalagent from claims arising from your use of our services, content you post, violations of these Terms, or violations of third-party platform terms.
12. Termination
You may cancel at any time through your dashboard. We may suspend or terminate access for violations of these Terms. Upon termination, data is deleted per our Privacy Policy.
13. Governing Law
These Terms are governed by the laws of the State of Florida, United States. Disputes shall be resolved through binding arbitration in Orlando, Florida.
14. Changes to Terms
We will notify you of material changes via email. Continued use after changes constitutes acceptance.
